Below you will find information about which personal data (this is all data that identifies you or makes you identifiable as a natural person (hereinafter “data subject”), such as name, address, e-mail address or even user behavior) we collect during your visit to our site and how it is used. Data subjects are visitors to our website and users of our online services.

Data subject rights

According to Art. 15 DSGVO, you have the right to receive information about the personal data stored about you, including any recipients and the planned storage period. If incorrect personal data is processed, you have the right to rectification in accordance with Art. 16 DSGVO. If the legal requirements are met, you can request the deletion or restriction of processing and object to the processing (Art. 17, 18 and 21 DSGVO).

If you wish data to be deleted but we are still legally obliged to retain it, access to your data will be restricted (blocked). The same applies in the event of an objection. You can exercise your right to data portability insofar as the technical possibilities are available to the recipient and to us.

If you think that the processing of personal data relating to you violates the General Data Protection Regulation, you have the right to lodge a complaint with the data protection supervisory authority responsible for us, the State Commissioner for Data Protection and Freedom of Information of North Rhine-Westphalia, https://www.ldi.nrw.de/, and with any other data protection supervisory authority.

Legal basis

The legal basis of our data processing is according to Art. 13 DSGVO the following:

  • Art. 6 para. 1 p. 1 a) DSGVO for processing of personal data with the consent of the data subject.
  • Art. 6 para. 1 p. 1 b) DSGVO for necessary processing of personal data for the performance of a contract with the data subject as well as for the implementation of corresponding pre-contractual measures.
  • Art. 6 para. 1 p. 1 c) DSGVO for processing of personal data necessary to comply with a legal obligation to which we are subject under any applicable law of the EU or under any applicable law of a country in which the DSGVO applies in whole or in part.
  • Art. 6 para. 1 p. 1 f) of the DSGVO for the necessary processing of personal data in order to protect the legitimate interests of us or of third parties, unless the fundamental freedoms and rights and interests of third parties are infringed. Fundamental freedoms and rights and interests of the data subject prevail. Legitimate interests are in particular our business interest in being able to provide our website, information security, the enforcement of our own legal claims and compliance with other legal provisions.

For this purpose, we use service companies that are separately obligated to discretion and data protection within the scope of service provision. Data is only passed on to the authorities in the event of overriding legal requirements.

Right of revocation

Consents given can be revoked by you with effect for the future in accordance with Art. 7 DSGVO.

Data security/encryption

This website uses “Hypertext Transfer Protocol Secure” (https). The connection between your browser and our server is encrypted.

Purposes of processing

General: Presentation of the company, provision of services and/or sale of products and communication via the Internet. The purpose of the data processing on this website is the information about products and services of our company with the possibility of the users to get in touch with the contact persons in the house.

1. General

Insofar as you have provided us with personal data, we use it to respond to your inquiries, to advise you and process contracts concluded with you, and for technical administration. Your personal data will only be passed on to third parties or otherwise transferred if this is necessary for the purpose of processing the contract, if this is necessary for billing purposes or if you have given your prior consent. You have the right to revoke your consent at any time with effect for the future, see right of revocation.

The legal basis for the collection, processing and forwarding of the data within the framework of the processing of the contract is Art. 6 para. 1 p. 1 b) DSGVO.

The deletion of this data takes place after the expiry of the applicable statutory retention obligations. If we are not subject to any statutory retention obligations, the data will be deleted when the purpose ceases to apply.

You have the right to information and the right to object to your data stored by us at any time. You can find further information under “Data subject rights” and “Right of revocation”.

2. Server Data Collection

Purpose of processing
When you visit our site, various server statistics are automatically stored, which your browser transmits to our provider’s server: Among other things, the IP address of your device, date and time of access, name and URL of accessed files, website from which access is made or from which you were directed to our site (referrer URL), browser used and, if applicable, the operating system of your device and the name of your provider are logged.

The mentioned data is processed by us for the purpose of smooth connection establishment and system security. A combination of this data with other data sources is not made. The IP address is anonymized. The accruing connection data is deleted automatically, usually for a maximum of seven days. If the website is misused, log data whose further storage is necessary for evidentiary purposes will be retained until the incident has been clarified.
The legal basis is Art. 6 para. 1 p. 1 f) DSGVO. Our legitimate interest arises from the fact that we want to ensure secure operation of the website and detect any attacks.

3. Contact Form and Request by e-mail

Purpose of processing
When using our contact form, we collect and store the name and e-mail address for the purpose of responding to your inquiry. The specification of the telephone number for a callback is optional. If you send us a contact request by e-mail, we collect and store the e-mail address and the data contained in the e-mail.

The legal basis is Art. 6 para. 1 p. 1 a) DSGVO, since you consent to the above-mentioned processing of your data when using the form as well as sending an e-mail. In addition, the legal basis also arises from Art. 6 para. 1 p. 1 b), as the storage of data is necessary for the fulfillment of a pre-contractual or possibly later contractual relationship.

The deletion of the data takes place when the purpose of the storage has ceased to exist, i.e. after answering your e-mail/contact form inquiry or when the matter related to the inquiry has been conclusively clarified.

You have the right to revoke your consent at any time without affecting the lawfulness of the processing carried out on the basis of your consent.

4. Cookies

Purpose of processing
This site uses cookies. These are small text files that are stored in your internet browser (e.g. Firefox, Chrome, Microsoft Explorer/Edge, Safari etc.) or by it on your computer (i.e. your operating system) when you visit our site. With the help of the cookie, which contains a certain string of characters, our website recognizes your Internet browser when you call it up again. We use our own cookies, so-called session cookies. Purpose of processing

The legal basis for the collection and storage of the data is Art. 6 para. 1 p. 1 f) DSGVO. Our legitimate interest is based on the fact that we can thus make it easier for you to find our premises.

6. YouTube

Purpose of processing
On this page, videos from third-party providers are embedded as content via the video portal “YouTube” of YouTube LLC with headquarters at 901 Cherry Avenue, San Bruno, CA 94066, USA. By clicking on a video and the associated use of YouTube, your data can be processed by “YouTube”. If you are logged in with your user account at “Google/YouTube” at the same time as you call up the video, YouTube can track from which sub-page of our website the video is called up. If you would like to prevent this data collection, please log out of YouTube before visiting our site or viewing the video. Details can be found in the terms of use of “YouTube” and, since “YouTube” is a “Google” company, the privacy policy of “Google”.

The legal basis is Art. 6 para. 1 p. 1 f) DSGVO. Our legitimate interest results from the fact that we offer you an informative added value about our activities or about information of professional interest to you by embedding the videos. For our part, no data is saved from you in the process. The interests of the data subjects are taken into account by deactivating the tracking functions in the YouTube code. 7. Use of Matomo / Piwik

Purpose of processing
The web analytics service Matomo (Piwik) is used on this website. Cookies are used for this purpose under certain circumstances. Cookies are small text files that are stored locally in the cache of the site visitor’s Internet browser. The cookies enable, among other things, the recognition of the Internet browser. The data collected in this way (including your pseudonymized IP address) is processed on our servers.
The information generated by the cookie in the pseudonymous user profile is not used to personally identify the visitor to this website and is not merged with personal data about the bearer of the pseudonym.

8. Data Protection Information on our Presence in Social Networks and Platforms

Barkey GmbH & Co. KG operates company presences on Facebook and LinkedIn. We operate these presences based on our legitimate interest to communicate with the users active there and to offer information in the networks / platforms.

Legitimate interests (Art. 6 para. 1 (f) DSGVO) – The processing is necessary to protect the legitimate interests of the controller or a third party, unless the interests or fundamental rights and freedoms of the data subject, which require the protection of personal data, override these interests.

Since data processing is always carried out by the providers of the networks (usually for market research and advertising purposes) and this processing partly takes place outside the area of the European Union, our presences are only directed at the respective users who are active there and who have consciously agreed to the terms of use of the respective providers.

In this regard, the US providers undertake to offer comparable guarantees of a secure level of data protection as the data protection standards of the EU.

In the consideration and implementation, we take into account in particular:

  • No exclusive information in the social networks and platforms, but purely information about posts and events.
  • No advertising and publicizing of our presence outside the respective networks/platforms – i.e. no explicit recruitment of users who have not agreed to the terms of use.
  • Regular evaluation of the presences in the social networks/platforms and risk assessments.
